Guide
AB 1755 (2024), amended by SB 26, rebuilt California lemon law procedure for sales from 2025 forward. Each manufacturer elects — for 5 consecutive calendar years, irrevocably — whether to be on the fast track (Code of Civil Procedure §§871.20–.30). The Department of Consumer Affairs' Arbitration Certification Program publishes the roster every December 15 for the following year and adds verified elections within 2 business days.
Fast track: a shorter, harder deadline (1 year after the warranty expires, never more than 6 years after delivery); the §871.24 notice that preserves civil penalties; 30-day restitution after a signed release with a mandatory $50 per late day; and a litigation fast lane (disclosures in 60 days, 2-hour depositions in 120, mediation scheduled by 90 and held by 150, discovery stayed until mediation ends).
Standard track: pre-AB 1755 Song-Beverly procedure, with its discovery-based, fact-specific timing — which is why this site refuses to print a single 'old track deadline.' As of the roster checked for this page, Ford, GM, Stellantis, Hyundai, Kia, Nissan, Subaru and Mercedes-Benz are IN; Toyota, Honda, Tesla, BMW, Volkswagen and Volvo are OUT. Law-firm 'trackers' online contradict the official roster — one prominent tracker marks Toyota, Honda, Tesla, BMW and VW as opted-in while its own brand pages say the opposite. Trust the DCA roster, and check the date stamp on ours.
